These terms explain how you may use Trashawk and what you can expect from us.
1. Agreement to these terms
These Terms of Service ("Terms") apply to the Trashawk website, the Trashawk app and the workspaces for admins, operators, clients and collectors (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for an organization, you confirm you are authorized to accept these Terms on its behalf.
2. What Trashawk does
Trashawk maps litter with drones, detects it with artificial intelligence, and organizes its pickup by picker drones, operators, collectors and volunteers.
AI detections are estimates. People review them, but some litter may be missed or misclassified. A cleanup does not guarantee that an area will be completely free of litter.
3. Accounts
- You must be at least 18 years old to create an account.
- Give accurate information and keep it up to date.
- Keep your password private. You are responsible for activity under your account.
- Each role (admin, operator, client or collector) only sees the areas and data it has been granted.
- Tell us right away at mflorez@trashawk.com if you think your account has been misused.
4. Clients
Clients include HOAs, private landowners and local governments. As a client, you:
- Confirm you have the right to authorize drone flights and cleanups over the areas you register, or will obtain it.
- Tell us about access rules, hazards and restrictions that apply to those areas.
- Pay the charges shown on our pricing page or in your written agreement, which takes precedence if they differ.
5. Operators
Operators are independent business owners, not employees or agents of Trashawk. A separate operator agreement covers territories, fees and support. As an operator, you:
- Hold a valid FAA remote pilot certificate and follow all FAA rules, airspace authorizations and local laws.
- Are responsible for your drones, equipment, insurance and the safety of every flight.
- Only fly over areas where the client has authorized the cleanup.
- Use footage and data only to provide the Service.
6. Collectors and volunteers
Collectors and volunteers take part by their own choice. When picking up litter, you agree to:
- Put your safety first. Use gloves and suitable equipment, and stay away from traffic, water and unstable ground.
- Never handle dangerous items such as syringes, weapons, chemicals or dead animals. Report them in the app instead.
- Respect property rules, posted signs and the people around you.
- Share your location only if you choose to. You can turn sharing off at any time.
7. Acceptable use
You agree not to:
- Use the Service, its footage or its data to watch, identify or track people.
- Break the law, including aviation, privacy and property laws.
- Access data, areas or accounts you are not authorized to use.
- Interfere with the Service, or copy, scrape or reverse engineer it.
- Upload content that is unlawful or that you do not have the right to share.
8. Your data and footage
Clients and operators keep their rights in the data they provide. You allow Trashawk to host, process and analyze that data, including drone footage and litter detections, to provide and improve the Service. This includes training our litter detection models. How we handle personal information is described in the Privacy Policy.
9. Third-party services
The Service relies on providers such as hosting, maps, video and payment services. Their own terms apply when you use them, and we are not responsible for them.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by law, Trashawk makes no warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
11. Limitation of liability
To the extent permitted by law, Trashawk is not liable for indirect, incidental, special or consequential damages. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
12. Indemnity
You agree to defend and indemnify Trashawk against claims arising from your breach of these Terms, your misuse of the Service or, for operators, your flights and operations.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or close accounts that break these Terms or put people, property or the Service at risk. Sections that by their nature should survive, such as payment, liability and indemnity, continue after termination.
14. Changes to these terms
We may update these Terms. When we make important changes, we will show the new version in the Service and may ask you to accept it again. The date and version at the top of this page show which text applies.
15. Governing law
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict of laws rules. Disputes will be handled by the courts located in Denver, Colorado.
